Bus Driver Faces Discipline for Kicking Teenage Girls Off of a City Bus for Kissing

Last week, two 14 year-old girls were kicked off a Trimet city bus in Portland, Oregon because they were kissing. Did the bus driver have the right to do this?

Queerty.com states that Maika Rich and Jocelyn O'Neal were kissing on the public bus when a female commuter complained. The driver asked them to stop, which they did, but went crazy when he saw the girls holding hands. The man then pulled over and left the 14-year old girls on the side of the road.

According to the Associated Press, the girls said the driver called them "sickos" after the female passenger complained about their kiss.

The 64 year-old driver has been driving city busses for 11 years.

Yesterday, all the apologies and promises of discipline for the bus driver came from Trimet. One of the girls' mothers, Ronnda Zezula, accepted the apology. She was concerned that the transit company didn't address why an 11 year veteran driver broke a number of basic rules. She also wondered why the discipline was being kept secret, thinking it may be because the company only wants to give the driver "a slap on the wrist". The family may still sue.

We live in a democratic society, not a free society.

By this, I mean that there are certain rules EVERYBODY has to follow, whether they agree with them or not. These rules are set by elected officials and elected and appointed judges, and often change to match the collective mindset of the time. What was not tolerated 50 years ago may be a right or privilege today.

The bus driver may have had his own opinion about homosexuality. And he has a right to like it, tolerate it or dislike it. And he even has right to speak up for it or against it (as long as it is not "hate speech"). But not when he is in performance of a public job.

When he signed up to be a public transit bus driver 11 years ago, he took on the responsibility for transporting ALL paying passengers from point A to point B. The only exceptions should be when a passenger is being offensive to others, or if there is a safety issue involved. He has to put any discriminatory feelings about race, gender, nationality or sexual orientation on the back burner until he turns in his bus keys for the day. This may be tough for a 64 year-old person to swallow, considering that he may have formed his opinions on homosexuality long before society became more educated about it and tolerant of it. But he must be at least tolerant of it as long as he's sitting in the Trimet driver's seat.

This being said, the girls are wrong as well because of the public physical display of affection in such a closed space where they had to know they would be seen. This can be written off to youthful indiscretion, though, as lots of young people do this. A lot of people are offended by public displays of affection and consider them rude, whether they are done by heterosexual or homosexual couples. The female passenger was within her rights to complain that she was offended, and the driver was within his rights to tell the girls to stop, which he did. He crossed the line when he called them "sickos" and later threw them off the bus for contuing to hold hands.

I'm hoping that the driver isn't fired, unless he has history of intolerance towards certain passengers on his bus. But he needs to sincerely apologize. He has to be punished in some way, perhaps with a suspension or a demotion to a lesser bus route. And he needs to be taught that when his personal beliefs clash with company policy and/or the law of the land, he has put his feelings aside while in performance of his public job.
